The marketing and exploitation of sports broadcasting rights in the post-Murphy era: legal and commercial challenges.
In October 2011, the European Court of Justice delivered its highly anticipated judgment in the FA Premier League v. QC Leisure and Karen Murphy v. Media Protection Services cases. The court ruled that rights holders cannot stop consumers from seeking better deals for TV sports subscriptions by importing decoding devices from foreign broadcasters. At the time, the judgment was deemed a game-changer for the way media rights are sold in the EU.
So far the Premier League and other major sports rights holders are sticking to the old recipe of licensing sports media rights on an exclusive territorial basis. The tactics used, however, are creating new tensions with the EU competition rules, free movement rules, and copyright law.
During this Lunch & Learn, we update you on the most recent developments and discuss the expected longer term implications for rights holders, broadcasters, and ultimately, the sports fan.
